Definition of Terms:

"Distance contract" – a contract signed between a trader and a consumer using only one or more distance communication means, under an organised distance sale or service provision scheme, which does not require the physical presence of the consumer and the trader. A contract shall not be deemed a distance contract if a consumer and a trader have negotiated the terms of the contract at business premises and concluded the contract using distance communication means; A remote contract is also not considered if the user reserves the item through the website and pays the purchase price of the item in advance, but agrees that the final agreement on the terms of the contract is made at the merchant's premises and he receives the item at the merchant's premises;

"Off-premise contract" - any contract between a trader and a consumer in a place, which is not the business premises of the trader, and that requires the physical presence of the trader and the consumer; a contract concluded on the business premises of a trader or through any means of distance communication immediately after the consumer was individually offered to conclude a contract in a place, which is not the business premises of the trader, in the physical presence of the trader and the consumer; a contract concluded during an excursion organised by a trader with the aim or effect of promoting and selling goods or services. A contract concluded in a notary bureau as a result of notarial actions shall not be deemed an off-premises contract;

"Customer" - any natural person who is offered goods or services, or who purchases or further consumes goods or services exclusively for private purposes and not for performing any commercial practice or industrial activity, crafting or other occupational activities;

"Trader" - any natural person, legal person or an association of persons acting within the scope of a commercial practice, as well as any other person acting in the name of or on behalf of a trader;

"Durable medium - any instrument which allows the storage of information for a long period and its non-modified reproduction for a period adequate for its use .

"Goods" (hereinafter "item"/"product") - any movable thing, as well as any material goods placed therein and/or disseminated in a digital form (goods posted by the store for sale on the website);

In case of online/remote purchase, the customer has the right to return the product within 14 days without giving any reasons. to refuse a distance contract or an off-site contract.

In such a case, the user should contact the Mistore, send it a filled form or other unequivocal proof, by which the user expresses his will.

The mentioned period shall be counted as:

From signing the contract, in the case of service contracts;

From acquiring physical possession of goods by a consumer or a third party designated by the consumer (except for a carrier), in the case of sales contracts;

From acquiring physical possession of the last part of goods by a consumer or a third party designated by the consumer (except for a carrier), where an order for delivery in parts is made by the consumer;

From acquiring physical possession of the first part of goods by a consumer or a third party designated by the consumer (except for a carrier), in the case of a contract for the regular delivery of goods (with a specified periodicity).

 

Condition of the product to be returned:

The item must have preserved its original appearance and must be in the condition in which it was purchased (with a seal, special protective layers, etc.);

The appearance of the item must not be altered/damaged;

When returning the item, the product must be accompanied by all the accessories provided at the time of purchase, including the box and documents (proof of payment, warranty card (if any), etc.).

While the delivery to the service center, an authorized person of the company will carry out a visual inspection of the item, in case of non-compliance with the above-mentioned criteria, the company has the right to refuse to return the item to the customer;

In case of rejection of the contract, the user is obliged to:

to return the goods to the trader or to a third party designated by him immediately after sending the notice of withdrawal from the contract, but no later than 7 calendar days, unless the trader himself undertook to take back the goods;

When the trader has undertaken to bear this cost himself or has not provided the customer with information that this cost would arise if the goods are returned.

Information about the submission of the mentioned form will be provided to the user immediately, on a durable medium – (any instrument which allows the storage of information for a long period and its non-modified reproduction for a period adequate for its use) .

Transportation of the returnable product:

If there is a desire to return the item, the user is obliged to ensure the delivery of the item to the relevant address: 19 University Street, or it is possible to use a courier company and use the delivery service.

The risk of damage/deterioration during product transportation is fully transferred to the customer; The customer is obliged to ensure the return of the item himself and pay the full costs associated with the return (including and not only transportation).

Consequences of refusing the contract:

In case of refusing of the contract, Mistore will return to the customer the amount paid in full within 14 calendar days after receiving the notification of refusing of the contract, if the goods purchased by the customer are returned within 7 calendar days after sending the notification. If the purchased goods are not returned by the customer, the money will not be returned to the customer.

In case of refusing from the contract by the customer, he will not be beared any costs (including delivery costs), unless the customer has chosen a more expensive delivery service than the standard delivery service offered by the trader or the price of the goods has been reduced as a result of a benefit that is not related to the goods with determining the nature, characteristics and functioning.

The amount will be reimbursed to the user using the same means of payment that the user used (unless the user agrees to use another means of payment and no additional costs will be incurred).

The Company is not obligated to refund to the Customer the amount paid to compensate for the additional cost associated with the Customer's choise of a non-standard or more expensive delivery service than that offered by the Company.

In the case of refusing from the purchase contract, the trader has the right to refuse the refund until the goods have been returned or the customer has received a document confirming the shipment of the goods, whichever is earlier, unless the trader himself has undertaken to take back the goods.

In the case of an off-premise contract, when the goods are delivered to the customer's home, the trader is obliged to take the goods back at his own expense, if, due to the nature of the goods, it is impossible to send them by post.

As a result of the refusal of the contract, the obligations assumed by the parties under the distance contract or the contract concluded outside the premises are invalidated, and what the parties received by its execution is returned to them.

The customer does not have the right to refuse the contract if:

• Has delivered the service provided for in the contract in full, it has started to deliver the service with the prior consent of the consumer and with the acknowledgement from the consumer that he/she will lose his/her right of withdrawal once the contract has been fully performed by the trader;

• The goods were delivered to the consumer tightly sealed, were unsealed after delivery, and therefore the goods are not suitable for return for reasons of health protection or hygiene;

• The item is not suitable for further sale (for example: it has been opened and its appearance for sale is broken);

• The contract provides that the price of the delivered goods or services depends on current fluctuations in the financial market that are beyond the control of the trader and that arose within the period determined by this Law for exercising the right of withdrawal from the contract;

  • The delivered goods or services are made to the customer's specifications or are clearly personalised;
  • The delivered goods are liable to deteriorate or expire rapidly;
  •  Goods which are, after delivery, according to their nature, inseparably mixed with other items of goods;
  • The consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance in accordance with the terms of the contract. This restriction shall not apply to additional services other than those rendered during the visit; sealed audio or sealed video recordings or sealed computer software were unsealed after delivery;
  • The contract was concluded as a result of a public auction;
  •  The digital content was delivered to him by an unreliable carrier, the performance of the contract began with the prior consent of the user, and the user knew that he would thereby lose the right to refuse the contract;

 

The condition of returning within 14 days does not apply to items whose selling price does not exceed 30 (thirty) GEL.
